Maintaining Residential Ties While Absent from California

Under University of California residence regulations, an individuals temporary absence from the state of California for business, pleasure or educational purposes will not necessarily constitute the loss of California residence unless acts inconsistent with a claim of continued California residence are committed. University regulations place the burden of proof upon the student to demonstrate his/her intention to remain a California resident during periods of absence from the state.

Because residential ties (1) differ widely from one individual to another, the Residence Deputy will consider only those residential ties which are specific to each individuals circumstances when determining the intent of an individual to remain a California resident during a temporary absence. Upon returning to California, a student (or the parent upon whom the student is dependent) will not be expected to establish residential ties which differ from those ties normally maintained by the individual(s).

The following are common examples of steps which may be taken by the student (or the parent upon whom the student is dependent) in order to demonstrate his/her intention to remain a California resident during a temporary absence:

  1. Continue to use a California permanent home address for all records: education, employment, financial, etc.
  2. Satisfy the California resident income tax obligation. Please note that an individual claiming to be a permanent resident of California is liable for payment of income taxes on his/her worldwide income from the date they establish a permanent residence in California, including income earned outside of California (in another state or abroad). Military personnel are taxable on their earnings only when stationed in their state of residence. Military members assigned to active duty outside of California are not taxable by the State of California while stationed elsewhere.
  3. Retain California voter registration and vote by absentee ballot.
  4. Maintain active bank accounts in California.
  5. Maintain a California Driver License and vehicle registration. If these must be changed temporarily while outside the state, they must be reestablished upon return to California and within the time prescribed by law.
  6. Store belongings in California.
  7. Maintain a domicile in California ("domicile"- a persons fixed, permanent, and principal home).

Establishment of any of the above ties outside the state of California (including another country) is considered to be inconsistent with a claim of California residence. Any residential ties which must be established outside of California during a temporary absence must be immediately relinquished upon return to California. In addition, any student who is attempting to establish residence in California and returns to his/her former place of residence, or the home of his/her nonresident parent(s) during periods when the University is not in session, will be subject to question as to whether he/she has the necessary intent to establish California as the permanent home.
